The Employment Act 2008 (the Act) came into effect on the 6th April 2009 and with it, implemented a number of significant changes that have important ramifications for both employers and employees.
From an employers point of view, it is imperative that the new legislation is adhered to so as to avoid any inadvertent breach.
Equally, it is vital that employees also comply so as to ensure that they do not fall foul of the Act which could have severe consequences for any compensation awarded at Tribunal.
Some of the important changes are as follows:
Repeal of the statutory disciplinary, dismissal and grievance procedures
Adjustment of awards for non-compliance with a Code of Practice
Amendment to the tribunals powers to reach a determination without having a hearing
Amendment to ACAS powers of conciliation
Extended powers in relation to awards in claims for unlawful deductions and redundancy payments
Changes to the enforcement regime for the National Minimum Wage.
