Motoring Offences & Road Transport

With the proliferation of speed cameras on the road, it’s increasingly difficult to keep your driving licence clean of penalty points. If you’re worried about a driving prosecution, we can help.

It should not be assumed that an invitation to plead guilty by post means there is no need to have a solicitor to represent you in court. Sometimes the very worst thing you can do is to plead guilty by post and hope for the best. Nowhere is this thrown more sharply into focus than where you risk amassing 12 or more penalty points.

Penalty points and disqualification

Any period of disqualification from driving is at the very least a considerable inconvenience. More than that, however, it could seriously damage you financially.

For any employee who needs to be able to drive either to get to work or to perform his or her work duties, a period of disqualification may put his or her employment in jeopardy.

Moreover, the self employed or an employer may, if there is a disqualification, see their business disadvantaged or even fail. You cannot drive a business if you cannot drive a car.

The penalty points system and the discretion to disqualify in certain circumstances (as well as compulsory disqualification in others) means that it is all too easy for the motorist to be deprived of the ability to drive.

Hence, we offer a specialist service to the motorist, a resource aimed at mitigating or avoiding disqualification (or the addition of penalty points to a driving licence which, at the least, stores up trouble for the future).

We have considerable experience in persuading courts that there is sufficient ‘mitigating circumstances’ to be taken into account, so as to justify not disqualifying a driver who would otherwise be off the road for at least 6 months.

Road Transport

To be called before a Traffic Commissioner on a Public Enquiry is not only an uncomfortable experience but also one that has the potential to seriously damage your business. You may be at risk of losing your Operator’s Licence, having it suspended or having the number of vehicles that you operate reduced.

Furthermore, a conviction before a Magistrates Court could itself precipitate your appearance before the Commissioner.

Hence, you need proper and timely advice and representation on a range of issues that may come before the court.

You need the right support and representation at times like these.

We can help with the following:

  • Representation before the Traffic Commissioner on Public Enquiries
  • Defence of prosecutions for overloading and Construction and Use offences
  • Defence of tacograph prosecutions
    - drivers' hours infringements
    - speeding
    - MOT, VED and operator licensing offences.
