Professional Negligence

When placing your trust with a professional adviser you expect to receive a professional service with sound advice. In a vast majority of cases your expectations will be met but professionals can make mistakes which may cause businesses and individuals alike to suffer financial loss, sometimes small but often very significant.

The term ‘professional negligence’ is used where a member of a profession has acted for you but has failed in their duty of care which has resulted in you suffering a quantifiable loss. This would include claims against accountants, architects, engineers, estate agents, financial advisors, solicitors and surveyors to name but a few.

To succeed in a professional negligence claim you will have to prove:

  • that the professional owed you a duty of care to provide the service in question with reasonable skill and diligence
  • that the professional has breached that duty, and
  • that the breach of duty has caused you financial loss.
